When Experience, Skill And Results Matter To You

Giving Service Members Time To Protect Their Parental Rights

When divorced or separated U.S. military service members with children get deployed or stationed in other states, it’s natural for questions and concerns to arise regarding child custody. Service members in this situation may not know they have protections under the law, let alone how to wield that power. Without help from an attorney, complex situations may only get worse and civil and parental rights may be adversely affected.

If you are a member of the U.S. military and are facing a child custody matter, turn to the experienced family law lawyers at Prater, Ridley & Llamas - Attorneys at Law. Our office in Temple, Texas, serves service members stationed at Fort Hoos and other installations in Central Texas.

Your Rights And Protections Under The SCRA

Service members with children who find themselves facing child custody disputes or other child custody matters should know that they have certain protections under the Servicemembers Civil Relief Act (SCRA).

The act gives service members, who are in a period of active service, the ability to temporarily suspend judicial and administrative proceedings for a period of 90 days. This amount of time can be extended by a judge if necessary.

The SCRA is a valuable tool in family law matters because it gives service members time to secure legal counsel, defend their parental rights and arrange leave — when possible — to handle legal matters in person.
